Terms and conditions of sale 

Acceptance of terms and conditions 

These general terms and conditions (hereinafter: “GTC”) are issued by the Fondation Plateforme 10 (hereinafter: “Plateforme 10”), Fondation Plateforme 10, Av. Ruchonnet 1, 1003 Lausanne (plateforme10.ch), which manages the following museums: mudac (mudac.ch), Musée cantonal des Beaux-Arts (mcba.ch) and Photo Elysee (elysee.ch). These GTC are published on these 4 websites and at the museum ticket desks in printed and digital form (scannable QR code). 

These GTC apply automatically and without restriction to all orders or purchases of admission tickets, in particular for museums managed by the Plateforme 10 Foundation or for events managed by it (in particular concerts and shows) and for particular activities (in particular group or individual visits) (hereinafter: “purchase” or “purchases”), made on the Plateforme 10 website, directly on site or via the websites of the museums managed by Plateforme 10. 

By ticking the box “I have read, understood and accept the general terms and conditions”, the person placing the order or making the purchase in question (hereinafter referred to as the customer) declares that he/she has fully read and understood the GTC, that he/she accepts without reservation that they apply to him/her and to his/her order or purchase, that he/she has the right to place the order or make the purchase in question, that he/she has the right to exercise his/her civil rights (or, failing this, that he/she holds the authorization of a competent person allowing him/her to place the order or make the purchase in question), that he/she has the necessary capacity of discernment and that he/she is at least 18 years of age (or, failing this, that he/she holds parental authorization allowing him/her to place the order or make the purchase in question). The user must have the necessary capacity of discernment and be at least 18 years of age (or, failing this, be the holder of a parental authorization allowing him/her to carry out the order or purchase in question). 

All personal data is treated as confidential and will be handled in accordance with Swiss data protection laws. The information required to process the order/reservation/purchase is processed electronically and may be passed on to associated companies for the purposes of processing the order or providing the service, and for marketing purposes. By accepting these GTC, the customer consents to the use of his/her data as indicated above. 

Purchase (tickets, reservations, gift vouchers) 

All prices are in Swiss francs and include all taxes (CHF). Plateforme 10 reserves the right to change prices at any time. The price indicated at the time of order or purchase on site is decisive. 

The sale of tickets for access to Plateforme 10 museums and for any of the aforementioned events or activities is subject to the quotas allocated to each offer. The indication of tickets accessible or orderable on the Plateforme 10 website or via the websites of the museums it manages is valid only as an invitation to the customer to submit a purchase offer. The availability indicated online is purely indicative, and in the event of unavailability after the order has been placed and before final confirmation of purchase by delivery of the ticket, Plateforme 10 reserves the right to cancel the order against reimbursement, without further compensation, of the price paid in this respect to the account of the card used to make the payment. 

Plateforme 10 does not guarantee the accessibility, functionality or availability of its services, in particular electronic services. 
To place an order, the customer must identify him/herself. In particular, he/she must enter his/her e-mail address. 

Tickets ordered online are delivered in electronic form, notably in the form of E-tickets. Neither postal delivery nor invoicing is envisaged, except in special cases requiring a prior request by e-mail to the following address: visites@plateforme10.ch; Plateforme 10 will then freely examine the possibility of proceeding and, in such special cases, will determine the conditions of payment and postal delivery. 

The customer is responsible for the correctness and accuracy of the information provided, particularly in connection with the order, i.e. in particular the information relating to the name and e-mail address (or, in the case of application of the preceding clause, the place of residence) of the recipient. All such information must be absolutely accurate, precise and complete. In particular, Plateforme 10 declines all liability in the event of erroneous addressing due to any failure to comply with the above, in which case any reimbursement of any ticket or any other compensation is excluded. 

It is the sole responsibility of the customer to have the equipment and resources, particularly technical and IT resources, to access the Plateforme 10 website or the websites of the museums it manages, to order tickets from them and to receive and store them without risk to him/her, to third parties and to Plateforme 10, particularly their equipment and facilities. The customer will take all measures to prevent any access or undue intervention by third parties. In particular, Plateforme 10 accepts no liability in this respect and reserves its rights in the event of any breach of the above by the customer. 

Ticketing gift vouchers are sold for any value between CHF 10 and CHF 300. They can be exchanged for museum tickets and guided tours at the current rates. Vouchers are valid for 10 years from the date of issue. Vouchers cannot be converted into cash.  Any balance remaining after a voucher has been redeemed will give rise to the issue of a new voucher of equal value to the balance, without extension of the initial validity. Cash conversion of this balance is not permitted. 

Booking guided group tours 

The purchase of a guided tour includes the accompaniment of a guide in the chosen language; individual entrance tickets for each person taking part in the tour must be purchased in addition. Reservations for guided group tours must be made at least two weeks before the date of the tour. Reservations will be processed as far as possible. Online bookings are only accepted for tours in French at the times and on the days indicated on the booking form. For tours in other languages, please send an e-mail to visites@plateforme10.ch. Plateforme 10 may require presentation of the ticket and confirmation of payment on the day of the tour, so the customer must bring this with him/her on the day of the tour. 

Prices 

Admission rates for different types of visitor (adults, children, students, etc.) are posted on the Plateforme 10 and museum websites and at the museum reception desk. They are subject to change at any time. All reduced-rate ticket holders must be able to show proof of entitlement at the museum cash desks in exchange for a ticket voucher. The presentation of an invalid receipt, or the absence of such a receipt, will result in refusal of access, and no refund or compensation will be given. 

Museum opening times  

Museum opening times are posted on the Plateforme 10 and museum websites. Plateforme 10 reserves the right to change opening times in exceptional circumstances. 

Methods of payment 

Payments must be made in Swiss francs (CHF).For on-site sales only, euros are also accepted. 

a) Prepayment: tickets, reservations and gift vouchers are payable upon order/reservation. 
b) Electronic means of payment: Plateforme 10 accepts Visa and Mastercard credit cards and debit cards for online payments. On-site payments can also be made by cash, Maestro, Postcard or Twint. Plateforme 10 reserves the right to refuse any or all of these methods of payment at any time, or to offer alternative methods. The amount actually debited from the account of the bank/postcard used will depend on the CHF rate/exchange rate on the day of debit, and on any charges levied by the card-issuing or card-managing institution. 
c) Payment for admission to events not connected with a museum visit may only be made by electronic means of payment and before the deadline indicated for booking the event concerned. 

Force majeure 

Plateforme 10 cannot be held responsible for any non-performance caused by force majeure (e.g. epidemics, pandemics, natural disasters, bad weather, war, terrorism, hostilities, civil unrest, militant activism). Plateforme 10 will then be free to decide on any refunds, without further compensation, it being specified that museum entrance tickets are in any case non-refundable. 

Loss or theft  

The conservation of the ticket and any security measures to be taken with regard to it, as well as the information it contains, is the sole responsibility of the customer. 

Plateforme 10 declines all responsibility in the event of loss, damage or theft of the ticket, including on the premises of Plateforme 10. In the event of loss or theft of the ticket, no refund or compensation may be requested from Plateforme 10. 

E-ticket 

The E-ticket is valid if it is presented on an interface such as a smartphone or tablet. The printed E-ticket is only valid if it is printed on white A4 paper, blank on both sides. 

Access to the event or exhibition concerned is subject to Plateforme 10 checking the validity of the E-ticket. 

The customer is solely responsible for the printing, quality and legibility of the tickets. 

In the event of an incident or poor print quality, the customer must print the E-ticket again prior to entry. To check the quality of the print, the customer must check that the information written on the E-ticket and the barcode are legible. 

The ticket must be printed in good quality. Partially printed, soiled, damaged or illegible E-tickets will not be accepted and will be considered invalid. Access will be refused and no refund or compensation will be given. 

Validity 

It is the customer’s responsibility to ensure that the order details are absolutely correct. 

Plateforme 10 is not obliged to check the identity of the person presenting the E-ticket in order to verify that this is the customer who ordered or purchased the ticket, or to check the authenticity of the E-ticket. 

Any reproduction, reprinting, copying, modification, imitation of the ticket (as well as any reuse of a ticket for a single service) and/or any redistribution, particularly electronic, of the ticket is expressly forbidden. Any ticket in question will be cancelled immediately, with no possibility of reimbursement or compensation, and all access by the persons concerned (both the customer and the person who presented the ticket in question) will be refused. Any further action is reserved, in particular against the customer. 

The only exception is the reprinting of a new copy of the ticket by the customer in the event of loss or damage to the E-ticket (the customer must be aware that access to the event may be refused in the aforementioned cases). In such cases, the damaged E-ticket must be destroyed immediately. 

Any exchange, purchase, sale, resale or donation of tickets for professional or commercial purposes is prohibited. Any ticket concerned will be cancelled immediately, with no possibility of refund or compensation, and all access will be denied to the persons concerned (both the customer and the person who presented the ticket concerned). In the event of suspicion, Plateforme 10 reserves the right to cancel the order concerned in advance. Any further action, in particular against the customer, is reserved. 

Tickets that have not been validly ordered, purchased or acquired do not entitle the holder to admission to the museum/event. No refunds or compensation will be made. 

Without the specific prior written consent of Plateforme 10, the customer is not authorized to use the tickets for any advertising, promotion or competition. 

On-site rules 

Placement 

Seating in auditoriums, public workshops and other museum areas is free, subject to availability (official safety gauge). We recommend arriving no later than 15 minutes before the start of the event. 

Safety and behavior rules 

Like all visitors, customers must abide by the rules and regulations (including the Plateforme 10 visitors’ regulations, which can also be consulted online and at the museum ticket desks), as well as the rules of safety and good conduct applicable within Plateforme 10 and its museums. These rules and regulations apply to all services offered or proposed by Plateforme 10. In particular, exhibits must not be touched or moved, and visitors are not permitted to take photographs with flash, or to use tripods or selfie poles. Plateforme 10 reserves the right to prohibit any recording at any time, particularly of images or sound. All filming and sound recording must be requested in advance from visites@plateforme10.ch, and requires completion of Plateforme 10’s filming and sound recording authorization form. 

Please note that the images, videos and other content presented in the museums are protected by copyright. In particular, any capturing, recording, reproduction, publication or distribution is strictly forbidden, except with the prior and specific written authorization of Plateforme 10. 

Once the event, activity or exhibition (beginning or ending at a specific or determinable time) has started, Plateforme 10 may refuse access to persons arriving late or tardily, or allow them to enter only at a time it deems appropriate. 

The customer is solely responsible for compliance with these provisions. Failure to do so may result in exclusion from entry or participation, without compensation or return/refund of tickets. 

Plateforme 10 further reserves the right to refuse entry or participation to any person it considers likely to breach the foregoing rules, without compensation or refund. 

If the customer breaches all or part of these GTC, Plateforme 10 may block the use of the services concerned and/or access to any electronic account, either temporarily or permanently, without compensation or refund. 

Cancellation, modification and refund 

Entrance tickets, guided tours, gift vouchers and events or any other activities are non-refundable. 

Guided group tours may be cancelled and reimbursed in full up to five days before the date booked. After this date, no changes or refunds will be made under any circumstances. All refunds will be made by bank transfer and must be requested in writing by e-mail to the following address: visites@plateforme10.ch. 

Plateforme 10 reserves the right to modify, move or cancel its events, activities and exhibitions at any time. In such cases, tickets will not be refunded. In the event of a complete and definitive cancellation, Plateforme 10 will offer tickets for another event, exhibition or activity of its choice. 

In the event of a refund request accepted by Plateforme 10 within the limits of these GTCs, the customer must provide Plateforme 10 without delay with all the information required to do so, failing which he/she will forfeit all rights in the matter; Plateforme 10 excludes all liability in the event of failure or negligence on the part of the customer, inaccurate data or failure or negligence on the part of a third party. 

Final provisions 

Plateforme 10 cannot be held responsible for any loss, theft or damage caused to or suffered by customers or visitors, with the exception of those caused directly by Plateforme 10’s gross negligence. 

All elements of the Plateforme 10 website (plateforme10.ch) or the websites of Plateforme 10 museums (mudac.ch, mcba.ch, elysee.ch), as well as those attached to them and/or located on the physical site of their activities, are and remain the exclusive intellectual and other property of Plateforme 10. In particular, it is forbidden to reproduce, exploit or distribute them. 

Plateforme 10 reserves the right to modify these GTC at any time. The version in force at the time of the order or purchase shall apply. 

Should one or more provisions of these GTC be or become invalid, unenforceable or void in whole or in part, this shall not affect the validity or enforceability of the remaining provisions of these GTC. 

The contract and these terms and conditions are governed by Swiss law, without regard to conflict-of-laws provisions and the provisions of the United Nations Convention on Contracts for the International Sale of Goods. 

The courts of Lausanne (Switzerland) shall have exclusive jurisdiction over any dispute or litigation arising from the contract and these GTC, in particular with regard to their interpretation or execution.
